Minister Rosa Weber, of the Federal Supreme Court (STF), rejected on Monday (6) a request from the Roraima government to close the state's border with

The minister's decision, however, does not revoke the determination of Judge Helder Girão Barreto, of the 1st District Federal Court of Roraima, who on Sunday (5) suspended the entry and admission of Venezuelans. Faced with Barreto's decision, the Federal Highway Police blocked the border on Monday(6).
 
On the request of the government of Roraima, Rosa Weber ordered that the judge of Roraima to be notified. It will be up to him to decide whether to revoke the decision made on Sunday or to keep the border closed, even if it contradicts the Supreme Court.
 
For Rosa Weber, closing the state border with Venezuela is contrary to the Constitution and international treaties ratified by Brazil.
 
"It is not justified, because of the difficulties that refugee accommodation naturally brings, to start with the easiest solution to 'close doors', equivalent, in the hypothesis, to 'close your eyes' and 'fold your arms'," she said.
 
In addition to the temporary closure of the border, the Roraima government also asked for R$ 180 million from the Union to deal with immigrants.The matter has not yet been analyzed, because the merits of the action will still be judge, at a date not yet expected.
 
Rosa Weber also ruled that the Attorney General's Office (PGR) is expected to take action on the Roraima government's decree, which has tightened Venezuelans' access to state public services.
 
On this decree, the General Advocacy of the Union (AGU) has filed an action in the Supreme Court arguing that the rules are unconstitutional.
 
According to the minister, Brazil has committed itself to Venezuela "not to adopt measures of international prophylaxis" that imply in the total closure of the border.
 
"The measures of migration management that may be adopted can not contradict the commitments made in the international treaties to which Brazil is a party," she said.
 
In another section of the decision, Rosa Weber also stressed that closing the border is a decision of the President of the Republic. 
 
In April of this year, President Michel Temer stated that the closure of the border was "inconceivable."
 
"The closure of the international border not only bears a typically executive nature but also translates into a true exercise of the sovereignty of the Brazilian State, thus consubstantiating an act reserved for the head of state," she said.
